Terms & Conditions

These terms set out the basis on which Restu provides its pension protection services and how our website may be used. Please read them with care before engaging us.

1. Definitions

For the purposes of these Terms and Conditions:

  • "Restu", "we", "us", "our" — Restu, a pension protection legal services firm registered in Johor, Malaysia, operating from No. 12, Jalan Molek 1/29, Taman Molek, 81100 Johor Bahru.
  • "Services" — any of our three engagement offerings: Pension Clarity Conversation, Pension Resolution Support, and Family Retirement Care Engagement.
  • "Client", "you", "your" — any individual who engages Restu for Services or uses our website.
  • "Website" — our website accessible at restum.pro and all associated pages.
  • "Engagement" — a formal service arrangement confirmed in writing between Restu and a Client.
  • "Agreement" — these Terms and Conditions together with any written engagement letter or service confirmation.

2. Acceptance of Terms

By using our website or engaging our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you are acting on behalf of another person, you confirm that you have the authority to do so.

  • You must be at least 18 years of age to engage our Services.
  • You confirm that you have the legal capacity to enter into a binding agreement under Malaysian law.
  • Use of our website for information purposes does not in itself constitute an engagement.

3. Service Description

Restu provides pension protection legal services within Malaysia, with a focus on EPF/KWSP entitlements, government pension schemes, and survivor pension matters. Our three Services are:

  • Pension Clarity Conversation (RM 560) — a structured session reviewing EPF and pension records and providing a plain-language written summary.
  • Pension Resolution Support (RM 1,210) — assistance with declined or delayed pension claims, including documentation and correspondence with relevant authorities.
  • Family Retirement Care Engagement (RM 1,930) — a comprehensive arrangement covering entitlement review, resolution support, and survivor pension documentation for household dependants.

Services are delivered in Johor Bahru and by written correspondence or telephone where appropriate. We do not currently offer Services outside Malaysia. Availability is subject to our capacity at the time of enquiry.

4. Your Responsibilities

Accurate information

You agree to provide accurate, complete, and up-to-date information throughout your engagement. Providing false or misleading information may affect the outcome of your matter and could result in termination of the engagement without refund.

Cooperation

  • Respond to our requests for information or documents in a timely manner
  • Notify us promptly of any changes to your circumstances that may be relevant to your matter
  • Maintain the confidentiality of any reference numbers, login credentials, or documents we share with you

Prohibited conduct

  • Using our website to transmit unlawful, defamatory, or fraudulent content
  • Attempting to interfere with the operation of our website
  • Misrepresenting your identity or authority
  • Using our Services for any purpose contrary to Malaysian law

5. Intellectual Property

All content on our website — including text, structure, design, and documentation templates — is the intellectual property of Restu or its licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use the website for personal, non-commercial purposes.

  • You may not reproduce, distribute, or adapt any part of our website without our prior written consent.
  • Written summaries, dossiers, and correspondence prepared under your engagement are for your personal use and may not be resold or redistributed.
  • Feedback or suggestions you share with us may be used to improve our services without obligation to you.

6. Fees & Payment

Fees

All fees are quoted and payable in Malaysian Ringgit (MYR). The applicable fee for your chosen Service will be confirmed in writing before your engagement begins.

Payment methods

  • Bank transfer (DuitNow / IBG)
  • Online banking
  • Other methods as agreed in writing at the time of engagement

Refund policy

Given the nature of our Services — which involve professional time, document review, and correspondence preparation — fees are generally non-refundable once work has commenced on your matter.

  • If you cancel before any work has commenced, a full refund will be considered.
  • Partial refunds may be offered at Restu's discretion where a matter cannot proceed due to circumstances outside your control.
  • No refund will be issued where a claim is not resolved in your favour, as outcomes depend on third-party decisions by government authorities.

7. Service-Specific Terms

Scope and changes

The scope of your engagement is defined in the written confirmation provided at the start. If you request additional work beyond the agreed scope, this will be discussed and confirmed separately before proceeding.

Timelines

We will act with reasonable promptness. However, timelines for resolution are also dependent on the response times of government authorities (EPF/KWSP, JPA, etc.), which are outside our control. We will keep you informed of progress and any delays as they arise.

Confidentiality

All information you share with us is treated as strictly confidential. We will not disclose your personal details or the nature of your matter to any third party except as required to advance your engagement or as required by law. See our Privacy Policy for full details.

8. Disclaimers

Our website and its content are provided for general information only and are not a substitute for specific legal or financial advice tailored to your individual circumstances.

  • Restu does not act as a licensed financial planner or investment adviser. We focus specifically on pension and retirement entitlement matters.
  • While we prepare documentation and correspond with authorities with care, we cannot control or predict decisions made by third-party bodies such as EPF/KWSP or the Public Services Department.
  • Our website is provided on an "as available" basis. We do not warrant that it will be error-free or uninterrupted.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Restu's liability for any claim arising from your use of our Services or website is limited to the fee paid by you for the specific Service to which the claim relates.

We will not be liable for:

  • Indirect, consequential, or incidental losses
  • Loss of income, pension entitlements, or savings where the outcome depends on decisions by government authorities
  • Delays or failures caused by circumstances beyond our reasonable control (including acts of government, system outages at third-party agencies, or force majeure events)

10. Indemnification

You agree to indemnify and hold harmless Restu, its directors, staff, and associates from any claims, losses, damages, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • False or misleading information you have provided
  • Your violation of any applicable Malaysian law

11. Termination

Either party may terminate an engagement by giving written notice. Restu may terminate immediately if:

  • You provide materially false information
  • Payment obligations are not met
  • Continuing the engagement would require us to act contrary to Malaysian law or professional standards

On termination, any fees for work completed up to that point remain payable. Clauses relating to confidentiality, intellectual property, and liability will survive termination of this Agreement.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute shall be subject to the exclusive jurisdiction of the courts of Johor, Malaysia.

Before initiating formal proceedings, we encourage both parties to seek resolution informally. Please contact us at [email protected] to discuss any concerns. We will endeavour to respond within 14 calendar days and to find a reasonable resolution where possible.

13. General Provisions

  • Entire agreement — these Terms, together with any written engagement confirmation, constitute the full agreement between the parties for the Services concerned.
  • Severability — if any provision is found to be unenforceable, the remaining provisions will continue in full force.
  • Waiver — failure to enforce any provision at any time does not constitute a waiver of our right to enforce it later.
  • Assignment — you may not assign your rights under this Agreement without our prior written consent. We may assign our obligations to a successor entity.
  • Notices — formal notices should be sent in writing to our office address or to [email protected].

14. Changes to Terms

We may update these Terms from time to time. When we do, the "Last Updated" date will be revised. For existing engagements, material changes will be communicated to you directly.

Continued use of our website following any update constitutes your acknowledgement of the revised Terms. We recommend reviewing this page periodically.
